1. Scope and Operator
These Terms of Service govern your use of KinoTrack (kinotrack.app), operated by fat elephant — Isabella Di Ponio-Voit, Blocksbergstr. 38a, 66955 Pirmasens, Germany. By using KinoTrack, you agree to these terms.
2. Description of Service
KinoTrack is a film and series tracking platform that allows users to log watched content, maintain watchlists, follow filmmakers, create discovery views, and interact socially with other users. KinoTrack is currently provided free of charge. Paid features may be introduced in the future with advance notice.
3. Account Registration
You must register an account to use most features of KinoTrack. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to register. You agree to provide accurate information and to keep it up to date.
4. Acceptable Use
You agree not to: use KinoTrack for any unlawful purpose, attempt to gain unauthorised access to any part of the service, scrape or copy content in bulk without permission, upload content that infringes third-party rights, or impersonate other users or persons.
5. User-Generated Content
Content you create on KinoTrack — including notes, list names, and profile information — remains your own. By submitting content, you grant KinoTrack a non-exclusive licence to store and display it as part of the service. You are responsible for ensuring your content does not violate any applicable laws.
6. Third-Party Data
Film and series data is provided by The Movie Database (TMDB). KinoTrack is not responsible for the accuracy or completeness of this data. TMDB data is used in accordance with their terms of service.
7. Availability
We aim to keep KinoTrack available at all times but cannot guarantee uninterrupted access. We reserve the right to temporarily suspend the service for maintenance or updates. We will endeavour to provide advance notice for planned downtime.
8. Account Termination
You may delete your account at any time via the settings page. We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.
9. Limitation of Liability
KinoTrack is provided 'as is' without warranties of any kind. To the extent permitted by law, fat elephant excludes all liability for direct or indirect damages arising from your use of the service. This does not affect statutory rights that cannot be excluded under applicable law.
10. Changes to These Terms
We may update these terms from time to time. Continued use of KinoTrack after changes have been posted constitutes acceptance of the revised terms. We will notify registered users of significant changes by email.
11. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for disputes is Pirmasens, Germany, to the extent permitted by law.
